We pursue disputes throughout the course of the lawsuit, from the preparation and filing of the complaint, through appeal, if necessary. We are equally at home in state or federal court, arbitration or mediation, and will work closely with you as our client to assure that you understand, and can participate in, key litigation decisions. We take cases at any stage of litigation, including after trial if you wish to pursue an appeal.

In each instance, we seek the most efficient and cost effective means to serve our clients. We appear in federal and state courts as well as mediate and arbitrate a broad range of disputes.

construction litigation
Since the early 1970’s, the firm has represented owners, developers, general contractors, construction managers, subcontractors, specialty contractors, material suppliers, public and quasi public bodies in property valuation, development, contract formation, construction, claims and bonding issues. We bring the breadth of this broad experience to our clients in the context of the efficiencies of a small firm setting.

Personal Injury
We have extensive experience helping clients who have suffered injuries caused by the negligence or other wrongful conduct of others. If you have suffered such an injury, we offer a free initial consultation. If you choose us to represent you, we will not charge you an attorney fee unless you recover money after trial or through settlement. You are responsible for court costs and litigation expenses other than attorney’s fees. We will guide you through the pretrial process, negotiate with insurance companies to maximize your recovery, and take your case to trial as soon as possible, if necessary.

We handle a wide variety of appeals in various subject matters including wills, trusts and estates, construction, commercial, municipal, employment, insurance coverage, constitutional law and personal injury. Moreover, we have extensive experience arguing appeals in both federal and state courts. We are able to work diligently and efficiently to hone in on, and argue on appeal, only the most relevant issues from your case, regardless of whether or not we handled your case at the trial level.

Wills and trusts
Attorney Donato and/or Attorney Suarez will confer with you to determine your objectives for your spouse and family after your death. We draft wills, trusts, living trusts, living wills, powers of attorney, health care agent appointments, and other necessary documents to assure that your wishes are followed as closely as possible in case of incapacity or death.

Estate administration
We represent estates, beneficiaries, executors and trustees in administering estates, attending all requisite probate court hearings.

For three decades, the firm has counseled and represented employees in a wide variety of disputes including wrongful discharge, covenants not to compete, improperly withheld wages and other compensation, and damages actions. Many of our clients have been legal and medical professionals who experience a variety of problems and issues with their professional associations and businesses.

We routinely assist medical professionals in the following matters: formation of and dissolution of Professional Corporations and Limited Liability Companies; transactional matters involving the sale and acquisition of practices; agreements for buyouts at retirement, death or other times of termination; and representation in litigation and arbitration of disputes that cannot be resolved through negotiation.

We regularly form Corporations, Partnerships and Limited Liability Companies for all types of businesses, whether they involve single or multiple owners. We also assist in the preparation of agreements between owners, shareholders and members with respect to the sale of their interests at death or early termination for any other reason.

real estate transactions
We have extensive experience in residential and commercial real estate transactions, representing both buyers and sellers, individuals and businesses. We will help you decide and form any desired entities to own your real estate such as Limited Liability Companies, Limited Partnerships or Sub-chapter S Corporations when appropriate. Attorney Donato and Lynne Tourville, the firm’s real estate legal assistant, have many years of experience in handling closings. Ms. Tourville works closely with clients, real estate agents, lenders, and other counsel to assure that each real estate transaction proceeds pleasantly and without needless distress. Our attorneys draft or review necessary contracts, confirm that your concerns are met, and make sure all documents are properly recorded.

insurance claims recovery
Increasingly, insurance carriers are denying coverage to insureds for improper and invalid reasons. Clendenen & Shea has extensive experience in representing insureds, whether individuals, businesses or governmental bodies, to obtain the insurance coverage purchased. We pursue these claims on behalf of our clients in federal and state courts as well as through mediation and arbitration.

bicycle injuries
The firm has extensive experience in litigating cases involving bicycle accidents. The firm has successfully tried before juries cases with complex and hotly-contested liability and damages issues. We have represented numerous clients who been struck by motor vehicles while riding their bicycles (and skateboards).
